Terms of Service

These terms are an agreement between you and Dominiek De Wilde (Sole proprietor (eenmanszaak) — natural person, trading as Wilde Performance Systems, enterprise number 0676.855.607), who operates the Tessumi service (“Tessumi”, “we”, “us”). By creating an account or using the service you accept these terms.
1. The service
Tessumi is browser-based software for planning venue floor plans: you upload a blueprint, calibrate it to scale, mark obstacles and exits, and the engine helps you lay out and count booths. It is a planning and visualisation tool.

3. Your account
- You must provide accurate information and keep your login secure.
- You are responsible for activity under your account.
- The service is intended for professional and business use.
4. Acceptable use
You agree not to:
- upload content you have no right to use, or that infringes others’ rights;
- upload unlawful content, or personal data you are not entitled to share;
- attempt to break, overload, reverse-engineer or circumvent the service or its limits;
- resell or redistribute the service except as expressly allowed by your plan.
5. Plans, fees and payment
We are rolling out paid plans. Prices shown on our pricing page are indicative and exclude VAT; the VAT-inclusive total and any applicable taxes are shown at checkout. Until checkout is enabled for a plan, no purchase can be completed and no fee is charged. The terms below apply once a plan becomes available for purchase.
- Single Event: a one-time fee of €249 (excl. VAT) to unlock one finished plan.
- Pro Planner: a recurring subscription, billed monthly or annually, that you can cancel at any time; it stops renewing at the end of the paid period.
- Venue Enterprise: priced per venue under a separate written order.
Payments are processed by Stripe; we never see your card details. Except where a refund is required by mandatory consumer law (including the pro-rata refund rules for services described in the withdrawal section below), fees are non-refundable.
6. Right of withdrawal (consumers)
If you are a consumer in the EU, you normally have 14 days to withdraw from a distance purchase. Where a plan delivers digital content or a digital service immediately, checkout asks you to (a) expressly consent to performance beginning right away and (b) acknowledge that you then lose your right of withdrawal once performance has begun. We confirm that consent and acknowledgement to you on a durable medium (your order confirmation email). If you withdraw from a paid subscription after consenting but before it is fully performed, you pay only a pro-rata amount for the service already supplied. This section does not apply to business customers.
7. Intellectual property and your content
- We own the Tessumi software, brand and engine.
- You keep all rights in the blueprints, plans and data you create or upload (“your content”).
- You grant us the limited right to host, process and display your content solely to provide the service to you.
8. Warranties and disclaimer
The service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any layout or measurement is accurate for your specific real-world use.
If you are a consumer, nothing in this section affects your mandatory legal rights, including the statutory conformity guarantee for digital content and services under Belgian and EU consumer law. Those rights are not disclaimed; the disclaimer above applies to you only to the extent permitted by mandatory consumer law.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost profit, lost business or data, or for any loss, injury or penalty arising from reliance on a plan that was not independently verified by qualified professionals and the competent authorities. Our total liability to you for any claim is limited to the amount you paid us for the service in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, or fraud. For consumers, the limitation above applies only to the extent permitted by mandatory consumer law and does not limit our liability for failing to perform an essential obligation of the contract or for lack of conformity of paid digital content or services.
10. Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or end access if you materially breach these terms or use the service unlawfully. You can request your data before closing your account, as described in our Privacy Policy.
11. Changes
We may update these terms as the service evolves. We will update the date above and, for material changes, give reasonable notice. Continued use after changes take effect means you accept them.
12. Governing law
These terms are governed by the laws of Belgium. Disputes fall under the competent courts of Belgium, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Consumers may also use the Consumer Mediation Service (Consumentenombudsdienst / Service de médiation pour le consommateur).
